Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tuned Voice, Inc. ("Tuned Voice," "we," "us," or "our") governing your use of the Tuned Voice app, website, and related services.

By downloading, installing, accessing, or using Tuned Voice, you agree to these Terms. If you do not agree, do not use Tuned Voice.

1. Eligibility

You may use Tuned Voice only if you can form a binding contract under applicable law. If you use Tuned Voice on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License Grant

Subject to these Terms and your valid license key purchase, Tuned Voice grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use Tuned Voice on Apple devices that you own or control. Each license key permits activation on up to the number of machines specified at purchase.

This license does not transfer any ownership rights in the app, software, models, branding, or related materials.

3. Purchases and Pricing

Tuned Voice is offered as a one-time purchase. We do not charge recurring subscription fees. Pricing is published on our website at the time of purchase.

Optional Voice Training may be offered as a separate paid add-on in a future version. Pricing for future purchases may change, but changes will not convert an existing one-time purchase into a subscription.

Taxes and payment processing are handled through Stripe. Except where required by law, purchases are non-refundable once the license key is delivered.

4. License Keys

Tuned Voice v1.0 uses license keys for activation — no user account is required. You are responsible for keeping your license key secure. We may deactivate a license key if we detect abuse, unauthorized sharing, or violation of these Terms.

5. Acceptable Use

You agree not to:

  • Use Tuned Voice in violation of applicable law, platform rules, or the rights of others.
  • Copy, rent, lease, resell, sublicense, distribute, or commercially exploit Tuned Voice except as expressly permitted by us in writing.
  • Reverse engineer, decompile, disassemble, modify, or create derivative works of Tuned Voice, except to the limited extent that applicable law expressly allows despite this restriction.
  • Interfere with or disrupt the app, our systems, or third-party services used with Tuned Voice.
  • Upload malicious code, attempt unauthorized access, or misuse Voice Training or account features.
  • Use Tuned Voice to infringe intellectual property, privacy, publicity, or other legal rights.

6. Voice Data and User Content

In version 1.0, all voice recordings and transcriptions remain on your device. No voice data is transmitted to Tuned Voice or any third party.

If a future version offers Voice Training, you will keep your rights in any content you upload, and you will give us only a limited permission to host, process, and use it to provide the Voice Training feature. We will update these Terms before that feature launches.

7. Intellectual Property

Tuned Voice and all related software, models, text, graphics, trademarks, and other content are owned by Tuned Voice, Inc. or its licensors and are protected by intellectual property laws. Certain aspects of Tuned Voice are covered by pending patent applications. Except for the limited license in these Terms, no rights are granted to you.

If you send feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

8. Service Changes and Availability

We may modify, improve, suspend, or discontinue all or part of Tuned Voice at any time. We do not guarantee that every feature will always be available, work on every device, or remain unchanged.

9. Termination

These Terms apply until terminated. We may suspend or terminate your access if you violate these Terms, misuse the service, create legal or security risk, or if we stop offering the service. Upon termination, the license granted to you ends immediately.

10. Disclaimer of Warranties

Tuned Voice is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by law. We disclaim all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that Tuned Voice will be uninterrupted, error-free, secure, accurate, or compatible with every device, operating system version, workflow, or third-party service.

11. Limitation of Liability

To the fullest extent permitted by law, Tuned Voice, Inc. and its officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenues, goodwill, or business interruption arising out of or related to Tuned Voice or these Terms.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to Tuned Voice or these Terms will not exceed the amount you paid us for Tuned Voice in the 12 months before the event giving rise to the claim.

12. Indemnity

To the fullest extent permitted by law, you will indemnify and hold harmless Tuned Voice, Inc. and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising out of your misuse of Tuned Voice, your content, or your violation of these Terms or applicable law.

13. Privacy

Your use of Tuned Voice is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Unless applicable law requires otherwise, any dispute arising out of or relating to these Terms or Tuned Voice will be brought exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction and venue.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here and revise the "Last updated" date above. Your continued use of Tuned Voice after updated Terms take effect means you accept the revised Terms.
